Judge grants City’s demurrer in lawsuit seeking tighter enforcement of Long Beach Airport noise rules

On September 30, 2025, Judge Michael P. Vicencia sustained the City’s demurrer to the lawsuit brought by the Small Aircraft Noise Reduction Group (SANeR).  The court ruled that the City’s airport noise ordinance clearly only applies to the four enumerated training operations mentioned in LBMC Section 16.43, which did not include taxi-back operations, as alleged by SANeR.  The court gave Petitioners 30 days leave to amend (i.e., until October 30, 2025) to allege the City failed to enforce the ordinance with respect to any of the enumerated training operations.
