Sexual Assault
Incidents involving a sustained finding that a peace or custodial officer engaged in sexual assault with a member of the public are subject to release through a Public Records Act request.
Sexual assaults under SB 1421 are limited to incidents involving the commission or attempted initiation of a sexual act by a peace officer or custodial officer with a member of the public by means of force, threat, coercion, extortion, offer of leniency or other official favor, or under the color of authority. The propositioning for or commission of any sexual act while on duty is considered a sexual assault.
A member of the public includes any person not employed by the officer’s employing agency and includes any participant in a cadet, explorer, or other youth program affiliated with the agency.
Dishonesty
Incidents involving a sustained finding of dishonesty by a peace or custodial officer are subject to release through a Public Records Act request.
Dishonesty incident subject to release are limited to incidents directly relating to the reporting, investigation, or prosecution of a crime, or directly relating to the reporting of, or investigation of misconduct by, another peace officer or custodial officer, including, but not limited to, any sustained finding of perjury, false statements, filing false reports, destruction, falsifying, or concealing of evidence.
